Rooney is trying to recoup millions that he says stepson Chris Aber squandered.

Facing foreclosure on his Southern California house, Rooney, 90, filed for legal protection from stepson Aber in February.

The Hollywood legend told a Senate committee in March that he suffered "unbearable" abuse over a 10-year period.

The new filing reveals he was five months behind on his mortgage by the time he sought the voluntary court conservatorship. Aber, he alleges, had diverted Rooney's $12,000-per-month income to finance a lavish lifestlyle.

The suit accuses Aber of "browbeating" Rooney into thinking he was insolvent and using his money to  buy two Mercedes, a Porsche and a $100,000 sportscar.
