LAPD To Appeal Ticket Quota Lawsuit Award

Saying that he does not agree with the jury's verdict, Los Angeles Police Department Chief Charlie Beck announced that the department will "make every effort" to appeal the award of $2 million to traffic officers who were allegedly retaliated against for not meeting a ticket quota.

"I don't agree with many jury verdicts and I don't agree with this one," Beck said at an afternoon news conference.

Howard Chan, who is now retired, and David Benioff, who remains on the force, were awarded about $2 million by a jury Monday, mostly for emotional distress.

The two allege that after complaining about a quota of 18 tickets per day, the department transferred the officers from a West Traffic Division motorcycle unit to less desirable duties after refusing to honor the quota.

"Chief Beck doesn't even know what happened in the case," said Gregory Smith, the attorney for the plaintiffs. "I'm quite certain we will prevail in the appeal. And you can't get better than 7 percent interest (on the jury's award) waiting for the appeal. It's just more money that tax payers will end up paying."
